ENCINITAS MENTAL HEALTH

1. ACCEPTANCE OF TERMS

Welcome to the website of Encinitas Mental Health ("Encinitas Mental Health," "we," "us," or "our"). By accessing or using this website (www.encinitasmentalhealth.com) or any services provided through this website, you ("you" or "user") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use this website or our services.

These Terms constitute a legally binding agreement between you and Encinitas Mental Health. We reserve the right to modify these Terms at any time. Your continued use of the website following any changes indicates your acceptance of the modified Terms.

 

2. BUSINESS STRUCTURE AND SERVICE PROVIDER

Encinitas Mental Health is a California Professional Corporation providing clinical mental health services. Clinical services are delivered by licensed mental health professionals including Licensed Clinical Social Workers (LCSWs), Licensed Marriage and Family Therapists (LMFTs), and Licensed Psychologists.

Management and administrative services are provided through a contractual relationship with Inspired Way Mental Health LLC, a California Limited Liability Company. This dual-entity structure complies with California's Corporate Practice of Medicine laws and ensures that all clinical decisions remain under the control of licensed clinicians.

 

3. SERVICES PROVIDED

Encinitas Mental Health provides the following mental health treatment services:

  • Partial Hospitalization Program (PHP) - Intensive outpatient mental health treatment, typically 5-6 hours per day, 5 days per week

  • Intensive Outpatient Program (IOP) - Structured outpatient mental health treatment, typically 3-4 hours per day, 3-5 days per week

  • Individual therapy sessions

  • Group therapy incorporating evidence-based practices (CBT, DBT)

  • Psychiatric evaluation and medication management (through contracted providers)

  • Neurodiversity Gifts curriculum integration

All services are provided in accordance with applicable California laws and regulations governing mental health treatment.

 

4. NOT EMERGENCY SERVICES

THE SERVICES PROVIDED THROUGH THIS WEBSITE AND BY ENCINITAS MENTAL HEALTH ARE NOT INTENDED FOR EMERGENCY SITUATIONS. IF YOU ARE EXPERIENCING A MENTAL HEALTH EMERGENCY OR CRISIS, PLEASE:

  • Call 911 immediately

  • Go to your nearest emergency room

  • Call the National Suicide Prevention Lifeline at 988

  • Call the San Diego Access and Crisis Line at 1-888-724-7240

Our website and services are not a substitute for emergency medical care or crisis intervention services.

 

5. NO DOCTOR-PATIENT RELATIONSHIP

Browsing this website, submitting contact forms, or sending emails does not create a doctor-patient or therapist-client relationship. A therapeutic relationship is established only after:

  • Completion of an initial intake assessment

  • Mutual agreement to treatment

  • Execution of required consent forms and treatment agreements

  • Assignment of a treating clinician

Information provided on this website is for general educational purposes only and should not be considered medical advice, diagnosis, or treatment recommendations for any specific individual.

 

6. ELIGIBILITY AND ADMISSION

Services are available to adults (18 years and older) who:

  • Reside in San Diego County, California

  • Meet clinical criteria for the appropriate level of care

  • Have insurance coverage with participating providers OR can pay privately

  • Are willing and able to participate in group-based treatment

Final admission decisions are made by our clinical team based on appropriateness of services, available capacity, and clinical criteria. We reserve the right to decline services or terminate treatment if clinically indicated.

 

7. INSURANCE AND PAYMENT

Encinitas Mental Health is currently credentialing with major California insurance plans. Insurance coverage verification is conducted prior to admission. You are responsible for:

  • Providing accurate insurance information

  • Understanding your insurance benefits, co-pays, and deductibles

  • Paying any amounts not covered by insurance

  • Notifying us of any changes to insurance coverage

We will make reasonable efforts to verify benefits, but insurance coverage determination is ultimately between you and your insurance company. You remain financially responsible for all services received.

 

8. PRIVACY AND HIPAA COMPLIANCE

We are committed to protecting your privacy and health information in compliance with the Health Insurance Portability and Accountability Act (HIPAA). Our Notice of Privacy Practices, provided at intake, describes:

  • How we may use and disclose your protected health information

  • Your rights regarding your health information

  • Our obligations to protect your information

  • How to file a privacy complaint

By using our services, you acknowledge receipt of our Notice of Privacy Practices. Your health information will only be disclosed as permitted by law and your signed authorizations.

 

9. CONFIDENTIALITY AND LIMITS

Mental health treatment is confidential. However, confidentiality has legal and ethical limits. We may disclose information without your consent when:

  • Required by law (e.g., court orders, subpoenas)

  • There is reasonable suspicion of child, elder, or dependent adult abuse

  • You present a serious threat of harm to yourself or others

  • You authorize disclosure in writing

  • For treatment, payment, or healthcare operations as permitted by HIPAA

  • In medical emergencies

You will be informed of these limits during the intake process.

 

10. CLINICAL DECISIONS AND PROFESSIONAL JUDGMENT

All clinical decisions regarding diagnosis, treatment planning, level of care, and discharge are made solely by licensed clinical staff using their independent professional judgment. Treatment recommendations are based on:

  • Individual clinical assessment

  • Evidence-based treatment practices

  • Professional standards of care

  • Patient safety and clinical appropriateness

While we incorporate innovative approaches like the Neurodiversity Gifts curriculum, all interventions are grounded in evidence-based practices and professional clinical standards.

 

11. PATIENT RIGHTS AND RESPONSIBILITIES

As a patient, you have the right to:

  • Receive treatment with dignity and respect

  • Participate in treatment planning decisions

  • Refuse treatment (except in emergency situations)

  • Access your medical records as permitted by law

  • File grievances or complaints without retaliation

  • Receive culturally competent care

  • Be informed of treatment options and alternatives

You are responsible for:

  • Attending scheduled appointments or providing advance notice of cancellations

  • Actively participating in treatment

  • Being honest with treatment providers

  • Following treatment recommendations

  • Respecting staff, other patients, and facility rules

  • Paying for services as agreed

 

12. CANCELLATION AND NO-SHOW POLICY

We require 24-hour advance notice for appointment cancellations. Repeated no-shows or late cancellations may result in:

  • Fees for missed appointments (if not covered by insurance)

  • Discharge from the program for non-engagement

We understand that emergencies occur and will work with you on reasonable scheduling issues.

 

13. WEBSITE USE AND INTELLECTUAL PROPERTY

This website and its content, including text, graphics, logos, images, and software, are the property of Encinitas Mental Health, Inspired Way Mental Health LLC, and/or their licensors and are protected by copyright, trademark, and other intellectual property laws.

20. DISPUTE RESOLUTION AND ARBITRATION

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the website, or services provided shall be resolved as follows:

A. INFORMAL RESOLUTION: Before initiating formal proceedings, you agree to contact us to attempt to resolve the dispute informally. Please send written notice to the address provided in Section 23.

B. BINDING ARBITRATION: If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration in San Diego County, California, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.

C. CLASS ACTION WAIVER: You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class action or representative proceeding.

D. EXCEPTIONS: Notwithstanding the above, either party may seek injunctive or equitable relief in court for intellectual property disputes or to prevent irreparable harm.

 

21. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

 

22. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Notice of Privacy Practices, constitute the entire agreement between you and Encinitas Mental Health regarding your use of the website and services, superseding any prior agreements or understandings.

25. ACKNOWLEDGMENT

BY USING THIS WEBSITE OR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
